What is it?

You can now separately manage legal basis for data processing and marketing communication consent in HubSpot Forms, giving you precise control over how you collect and honor your contacts' consent and preferences.

Why does it matter?

We're making consent collection in forms more intuitive, flexible, and reliable so that you can navigate multi-regional requirements with ease. Distinct settings for legal basis and marketing consent help you meet GDPR, CASL, CAN-SPAM, and APAC requirements without guesswork, giving you confidence that your forms are set up correctly.

How does it work?

The updated Forms experience gives you clear, flexible consent management with an improved interface:

New forms editor (v2) experience

When you create or edit a form, you'll see a redesigned "Privacy & Consent" section in the primary navigation that clearly separates:

  • - Communication consent - Permission to send marketing emails and communications
  • - Legal basis for data processing - The lawful basis for storing and processing contact data
  •

For non-GDPR users:

  • - Forms display permission-to-communicate text by default
  • - Full flexibility to hide, configure, or delete consent options
  • - Edit consent language directly in the form editor
  • - Select one or more subscription preferences (tag) to associate them with the form (required for marketing consent)
  •

For GDPR-enabled users:

  • - Forms display explicit consent checkboxes for both data privacy and marketing communication permissions by default
  • - You can hide, configure, or delete these checkboxes together or independently
  • - Customize the consent text directly within the form editor to match your specific use case
  • - Select one or more subscription preferences (tag) to associate them with the form (required for marketing consent)

Conditional logic:

  • - The "Store & process data" and "Privacy policy" fields can be shown or hidden based on form responses using conditional logic.
  • - Conditional logic requires a Marketing Hub or Content Hub Professional or Enterprise subscription.
